Refund policy

In accordance with applicable legislation, and in particular Articles L.221-18 to L.221-28 of the French Consumer Code, the Customer has a period of fourteen (14) days following receipt of the Product to exercise their right of withdrawal, without having to provide any reason for their decision or incur any penalties. The Company extends this statutory period by sixteen (16) days, thereby allowing the Customer to exercise their right of withdrawal within thirty (30) days from the date of receipt of the Products (this period begins on the day following receipt of the Product and, if it expires on a Saturday, Sunday, public holiday or non-working day, it is extended until the next working day).

In the case of an order comprising several Products delivered separately, or an order consisting of multiple lots or items delivered over a defined period, the withdrawal period begins upon receipt of the last Product, lot or item.

To exercise their right of withdrawal, the Customer is invited to notify the Company in writing of their decision to withdraw before the expiry of the aforementioned withdrawal period, by means of an unambiguous statement (for example, using the standard withdrawal form attached to the Terms and Conditions of Sale). The Customer may do so by sending a letter to the Company at the address specified below, by sending an email to eshop@gerarddarel.com, or by using the online procedure described in the “FAQ” (Frequently Asked Questions) section of the Website.

In accordance with Article L.221-23 of the French Consumer Code, the Customer then has fourteen (14) days following notification of their decision to withdraw to return the Product(s) concerned. The Company extends this statutory period by sixteen (16) days, thereby allowing the Customer to return the Product(s) concerned within thirty (30) days from the date of such notification.

For any return made under the right of withdrawal, the procedure below must be followed in full:

If the Customer has a customer account:

  • The Customer must register their return on the Website under the “My Orders” section. To do so, the Customer must click on the order containing the Products they wish to return and then click the “Make a Return” button. They must follow all the instructions and confirm their return request. The request will then be registered, and the Customer may download their return label if it was not included in the parcel or if they have lost it.

  • The Customer must attach the provided return label to the return parcel.

  • For metropolitan France, the Customer must drop off the labelled parcel at a post office or Colissimo collection point (the list of collection points is available on the Colissimo website). For the French Overseas Departments and Regions (DROM), limited to Guadeloupe and Martinique, the Customer must drop off the labelled parcel at a DHL collection point (the list of collection points is available on the DHL website).

If the Customer does not have a customer account:

  • The Customer must register their return online using the “Make a Return” link at the bottom of the page and provide their order number, which can be found on the delivery note and in the order tracking emails.

It should be noted that, in all cases, the Products must be returned in their original packaging, together with any accessories, and in a condition allowing them to be immediately resold (the Customer may be held liable for any depreciation in the value of the Products resulting from handling other than that necessary to establish their nature, characteristics and proper functioning), to the following address:

DS FASHION GROUP

GERARD DAREL – Zone de Moimont – SED Bat B2 – Quai 93/94

Return costs are borne by the Company only for orders shipped within metropolitan France. If the Customer chooses not to use the prepaid return label provided by the Company for returns from metropolitan France, the return costs shall be borne by the Customer. Return costs shall also be borne by the Customer for orders shipped outside metropolitan France. The Customer bears the risks associated with returning the Products.

Subject to compliance with the conditions set out above, the Company will refund the Customer the amount paid, including VAT, for the returned Products (the price of the Product(s)) at the time of the order.

Where delivery charges were included in the order amount, these will be refunded up to the cost of the standard delivery method.

The Company will refund the Customer the aforementioned amount within fourteen (14) days from the date on which it was informed of the Customer’s decision to withdraw. The Company may defer the refund until it has received the Products returned by the Customer or until the Customer has provided proof that the Products have been dispatched to the Company, whichever occurs first.

The refund will be made using the same payment method used by the Customer when placing the order. In the event of payment using a voucher generated through our second-hand platform, the Customer will receive a voucher of equivalent value.

Please note: The right of withdrawal may not be exercised for the contracts listed in Articles L.221-2 and L.221-28 of the French Consumer Code, including, in particular:

  • the provision of services that have been fully performed before the end of the withdrawal period, where performance began with the consumer’s prior express consent and express waiver of their right of withdrawal, provided that the service has been fully performed by the Company;

  • the supply of goods made to the consumer’s specifications or clearly personalised;

  • the supply of goods that are liable to deteriorate or expire rapidly;

  • the supply of goods that have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection;

  • the supply of goods which, after delivery and due to their nature, become inseparably mixed with other items.
